Zoning Bulletin

Variance-City directs new construction
be removed after originat pre-existing
nonconforming structure is demolished

Homeowners argue that because of variance issued for
reconstruction, new home should be treated as a conforming use

Citation: Goyonaga v. Board of Zoning Appeals, 657 S.E.2d 153
(Va. 2008)

VIRGINIA (02/29/08)-The Goyonagas owned a residential home
in the city. The Goyonagas' home and lot were pre-existing noncon-
forming uses. The lot and home predated the zoning ordinance in af-
fect at the time of their application for a variance. The lot did not
meet size requirements, and the home did not meet setback require-
ments, of the zoning ordinance.
After receiving a variance from the city to enlarge and extend their
home, the Goyonagas began demolition on portions of their home.
After initial demolition, the city's building inspector required addi-
tional demolition of the exterior walls. More than 75% of the origi-
nal structure was demolished.

.'51;~i::~:)~I~it~:~J~t.i~lti~~J~
tll!~I\llf~~~a!j!::~

'fkerised tc, pr;;ctice lawin a particular jurisgid:lon.
