Absent: Councflmember Beyer. <br /> <br />COMMISSION BUSINESS <br /> <br />Case #1: Nuisance Abatement - Hog Farm (PIN 14-32-25-43-0001) <br /> <br />Zoning Adminis~tator Frolik stated that since 1991 there have been numerous complaints about <br />odors from ~ hog farm on St. Francis Boulevard N.W. Ms. Frolik stated that Mr. Barthold has <br />applied for a".feedlot permit through the Minnesota Pollution Control Agency. Mr. Barthold <br />currently ha8 750~pigs on his farm and the MPCA is recommending reducing that number to 450 <br />pigs. Ms. Fxi~lik~stated that reducing to 450 pigs will hopefully work as an odor management <br />plan. She added :!here were no odor complaints in 1990 and City Staff is asking Mr. Barthold to <br />furnish them With~informafion regarding the number of pigs he had at that time. <br /> <br />Motion by COunoilmember Peterson and seconded by Mayor Gilbertson to direct Mr. Barthold to <br />reduce the hog faXm operation to 450 pigs in accordance with MPCA recommendations by July 1, <br />1992. <br /> <br />Further discBSsion: Council suggested it might be beneficial to send a letter to the residents who <br />complained tr~ the;past about the odor, informing them of the odor management plan. <br /> <br />Motion carried. Absent: Councilmember Beyer. <br /> <br />Case #2: Authorization to Acquire Easements from Neil Guy Estate <br /> <br />Mayor Gilbertson:tumed the meeting over to Councilmember Peterson. <br /> <br />City Enginoer Jankowski stated that on November 26, 1991, the City Council authorized the <br />initiation of. casotnent acquisition proceedings to acquire a 20 foot permanent and a 30 foot <br />constmction{asement along the southern border of the Guy property to facilitate the sewer and <br />water instal~fion;for Project//91-01. Mr. Jankowski stated that although the City could proceed <br />with conde~fion of the easements, the City Attorney has negotiated a proposed settlement. The <br />settlement proposes a compensation award for the easements which is based on 50% of the land <br />value for the permanent easement and 10% of the land value for the temporary easement. He <br />added that thetrfistee for the Guy property has submitted an appraisal which values the land at <br />$1.50 per squ~u'e foot. The City Assessor feels this amount is somewhat high and suggests that <br />the value is ¢li~ser to $1.00 per square foot. Mr. Jankowski stated the proposed negotiation would <br />mean a payment of $6,634.50 for the permanent easement and $1,990.35 for the temporary <br />easement for.' a total of $8,624.85. He stated there are two factors which favor authorization of the <br />easements f0vthe negotiated amount.
