<br />would be located. The remaining 28' acres will remain as Outlot A at this time. Both lots meet <br />minimum lot width, frontage, and size requirements. <br /> <br />As a part of the minor subdivision, the applicant is dedicating 30 feet of additional right-of-way <br />for Variolite Street, in accordance with the City's request. <br /> <br />The site proposes one access from 161st Avenue. However, staff is requesting that an additional <br />access be added, preferably in line with Xenolith Avenue to the south. <br /> <br />A trail will be required to be constructed along 161 st Avenue within the boundaries of the plat. <br />This includes the frontage along the Outlot leading to Central Park. Also, it is the City's policy to <br />require trail construction on both sides of MSA roads, and Variolite Street is an MSA road. <br />However, due to the relative distance and cost associated with that portion of trail on Variolite <br />Street, staff would be comfortable simply requiring a trail easement until more use would be <br />gained from trail construction. The applicant has stated that they believe paying the trail <br />development fee and constructing the trail along 161 st Avenue (or Variolite Street) is a <br />duplicative fee. <br /> <br />Park dedication is also due upon this plat. The commercial charge for park dedication is <br />$4,738.00 per acre, or 5% of gross land area. The applicant has expressed concern with the <br />amount due on park dedication, given the non-commercial nature of the use and would like to <br />discuss this. <br /> <br />Staff recommends approval of the minor subdivision, contingent upon the items called out in the <br />City Staff Review Letter, dated March 28,2008. <br /> <br />Mr. Dick Bromley stated he had a cOlicern with adding a second access on the land that will not <br />be developed and he proposed they work with staff to reach a way to provide safe access to the <br />lot in a way that did not require the temporary paving. He thought they could widen the drive to <br />have a three lane non-divided entry way less likely to be blocked or they could provide some <br />means to temporarily allow access to the lot from the east/west area. <br /> <br />Assistant City Engineer Himmer stated discussions could be made to find something that will <br />work. <br /> <br />Chairperson Nixt recommended having staff work with the applicant to find a reasonable means <br />for access. <br /> <br />Mr. DuFon stated the only other concern was the trail fees and trail. He did not feel they should <br />need to put in a trail because the services they will be offering will be open for the public and the <br />cost to construct that trail would be prohibitive from the parish standpoint for this development. <br /> <br />Assistant City Engineer Himmer stated if the applicant would construct the trail along 161 st, an <br />easement could be dedicated to the City and a trail would be built by the City on Variolite. <br /> <br />Planning Commission / April 3, 2008 <br />Page 14 of21 <br />
