The sketch plan also identifies the location of existing structures and indicates that they comply
with both principal and accessory structure property line setbacks. However, there is existing
pavement and fencing that span the proposed new lot line. The development agreement will
address these issues by requiring cross access easements where shared use of the pavement exists
or, in the event either lot is sold to another party, these encroachments be corrected and brought
into compliance with current regulations. The proposed lot split does not require any new roads
and access to both lots will be gained from Baugh St.
The sketch plan was approved by the Planning Commission on April 3, 2008. The sketch plan
identifies the location of existing structures and the fact that they comply with minimum setback
requirements.
The plat was reviewed by the Park Commission on April 10, 2008. A cash payment has been
recommended to satisfy park dedication requirements for Lot 2 and a fifteen (15) foot wide trail
easement along the northeasterly property line of Lot 1 has been recommended in lieu of the trail
development fee. The existing homestead is exempt from park dedication, trail fee, and
stormwater management fees.
Recommendation:
City Staff and the Planning Commission recommend final plat approval.
Funding Source:
All costs associated with processing the Minor Subdivision request are the responsibility of the
applicant.
Council Action:
Motion to adopt Resolution #08 -05 to approve the final plat of Kings Ranch Estates
contingent upon compliance with City Staff Review Letter dated May 9, 2008 and the Developer
entering into a development agreement with the City.
-or-
-176—
Motion to deny final plat approval.
Review Checklist:
City Administrator MAYA
t3'
Asst.
