-186- <br />Four Hundred Seventy -Five dollars and no cents ($2,475.00) (1 lot x $2,475.00 per lot). <br />This fee shall be paid prior to the CITY releasing the Final Plat for recording. <br />Trail Development Fee. The CITY has enacted a trail development fee and the current <br />rate is Six Hundred Dollars and no cents ($600.00) per lot. Lot 1 is an existing <br />homestead and is exempt from trail development fees. It is herein agreed that the trail <br />development fee for Lot 2 is waived but that the DEVELOPER shall provide a fifteen <br />(15) foot wide trail easement along the northeasterly property line of Lot 1 of the Plat to <br />the CITY as a separate, recordable document to satisfy the trail development fee for the <br />Plat. <br />. Stormwater Management Fee. The CITY has enacted a Stormwater Management Fee <br />and the current rate is Four Hundred Twenty Five Dollars and no cents ($425.00) per unit. <br />Lot 1 is an existing homestead and is exempt from this fee. Therefore, a cash payment in <br />the amount of Four Hundred Twenty Five Dollars and no cents ($425.00) shall be <br />required to satisfy stormwater management fees for Lot 2 of the Plat. This fee shall be <br />paid prior to the CITY releasing the Final Plat for recording. <br />9. Tree Planting Prior to issuance of a Certificate of Occupancy, the DEVELOPER shall <br />plant two new one (1) inch diameter overstory trees in the front yard of each lot of the <br />Plat. However, it is herein agreed that the landscaping requirements be waived for both <br />lots in lieu of existing tree cover within the Plat. In addition, the DEVELOPER shall <br />comply with the following: <br />a ) Minimizing the impact of construction on trees in accordance with Minnesota <br />Extension Service publication "Protecting Trees From Construction Damage" <br />(Publication #NR -FO- 6135 -S). <br />b) In the event the weather is not conducive to tree planting at the time of Certificate of <br />Occupancy, the Building Permit holder shall place a cash deposit in the amount of <br />Three Hundred Dollars and no cents ($300.00) for trees in an escrow account with <br />the CITY and upon verification of the planting being accomplished, said cash <br />deposit shall be refunded to the Building Permit holder. Failure of the Builder to <br />comply with the planting requirement within a reasonable time frame following a <br />determination by the CITY that weather conditions are conducive to planting shall <br />give the CITY authority to cause the planting, the cost of which shall be charged to <br />the escrow account and the Builder shall not be eligible for a refund of the cash <br />deposit made for this purpose. <br />10. Tree Disease Prevention and Disposal. The DEVELOPER shall prevent the <br />introduction and spread of tree disease into the residual tree populations of the Plat and <br />adjoining properties as well as mitigate the effects of construction activity on tree health, <br />within and outside of the Plat.
