<br />. CASE # / <br /> <br />REPORT ON 160TH AVENUE MEDIATION SETTLEMENT <br />By: Steven Jankowski, City Engineer <br /> <br />Background: <br /> <br />The Trappers Ridge subdivision consists of a two lot subdivision which was platted at the <br />terminus of 160th Lane in 2004. The westernmost 420 feet of 160th Lane has not been <br />constructed~ however a 66 foot road easement existed over the two properties at the end of the <br />paved street. It was subsequently determined that this easement was not specifically dedicated to <br />the City. As a result the City purchased the right of way from these properties and the Trappers <br />Ridge lot property owner constructed his driveway through the right of way to obtain ingress and <br />egress to his lot. <br /> <br />Beginning in the summer of 2005 staff had received phone calls from the property owners at the <br />end of 1 60th Lane disputing the use of the drive access t~at had been constructed within this right <br />of way. ill an effort to resolve the neighborhood dispute surrounding this situation~ the neighbors <br />agreed to enter into mediation with Anoka County Mediation Services. Notice was delivered to <br />the participants of the mediation that the case has been settled with the consensus that the City <br />should maintain the right of way. A copy of the dispute settlement agreement is attached. <br /> <br />Recommendation: <br /> <br />Gerald Bauer Jr., owner of the Trappers Ridge lot~ is agreeable to performing a portion of the <br />required improvements to comply with the mediation agreement. Staff hereby recommends that <br />the following be performed by the Public Works Department: <br /> <br />a) The right of way of cleared oftrees 18 feet on each side of centerline. <br />b) Stumps be grubbed and the roadway graded to a width of36 feet. <br />c) Sign both sides of the roadway for No Parking <br /> <br />Mr. Bauer has agreed to: <br />a) Place a 20 foot wide, four inch lift of class 5 in the path graded by the Public Works <br />Department <br />b) Pave a 12 foot wide lift of bituminous pavement centered within the 20 foot based area <br /> <br />Financial Impact: <br /> <br />The financial impact of this work is estimated to be $3,774 with a detailed breakdown as <br />follows: <br /> <br />a) Tree removal will be done by our correctional workers <br /> <br />$400.00 <br />
