Jake Barthol~t stated he was trying to reduce his herd size and added that he came in to City Hall in <br />July to inforff~ S~aff he couldn't get the herd reduced in the time frame planned. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beyer to direct the City <br />Attorney to ~gin abatement of the hog farm nuisance by legal means. <br /> <br />Motion carrie_ d. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Beyer, Hardin and <br />Zimmerman.: VOting No: None. <br /> <br />Case #2: Rivenwick Development Agreement <br /> <br />City Administrator Schroeder requested that Council approve the Rivenwick Development <br />Agreement~ ~s Presented with the caveat that City Staff and the Developer can agree on future <br />phases of pa& dedication. <br /> <br />Discussion ehsued regarding construction of MSA streets. <br /> <br />Bill Chapman, 365 E. Kellogg, St. Paul, MN - stated that he has been working with Faye Addition <br />since 1989, !It was through the sketch plan stage in October, 1990 and final plat stage in July, <br />1992. He St~ted~he objects to the provision which limits the use of MSA funds for this project. <br />He felt there haslbeen a policy change just this year regarding MSA funds. He asked that the City <br />Attorney review the ordinances, policies and the Development Agreement. <br /> <br />City Administrator Schroeder informed Council that Mr. Chapman is asking for Council approval <br />to do the sttlxhvts~on and he s asking the City to pay $330,000 in MSA funds for all three stages <br />of Riverda.[e!Drive N.W. as opposed to the $110,000 that Staff feels is fair. He felt the City <br />doesn't ha~,elanY interest in contributing that significant subsidy to this project. Mr. Schroeder <br />suggested theft tlxe developer should pay an amount equal to the cost of a standard City street and <br />the City should pay the additional costs incurred to construct the street to MSA standards. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beyer to table approval of <br />the Rivenwicfk Development Agreement and directed the City Attorney to review the ordinances, <br />policies and!deV~elopment agreements used by the City in the past as it relates to MSA road <br />construction ~tnd Clarify these for Mr. Chapman. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Beyer, Hardin and <br />Zimmerman.: Voting No: None. <br /> <br />Mr. Richard BlOom, representing Rivenwick Corporation, stated they have reviewed the <br />Development-Agreement and they are in full agreement with it. <br /> <br />Case #3: <br /> <br />Request for a Conditional Use Permit to Establish a Heavy Industrial <br />Use in the Business Warehouse (BW) District; Case of Bury and <br />Carlson <br /> <br />Case #4: <br /> <br />Request for Final Plat Approval of Bury and Carlson Addition, a <br />Minor Subdivision; Case of Bury and Carlson <br /> <br />Motion by COunoilmember Peterson and seconded by Councilmember Zimmerman to table cases 3 <br />and 4 to allow for the local business people to tour the present facility of Bury and Carlson in <br />Burnsville. <br /> <br />City Council/August 11, 1992 <br /> Page 4 of 6 <br /> <br /> <br />
