<br />CASE # <br /> <br />a <br /> <br />CONSIDER HEARING EXAMINER'S RECOMMENDATION RELATING TO <br />P A WNBROKERLICENSE AT 6101 IDGHW A Y 10 <br />By: William K. Goodrich, City Attorney <br /> <br />Background: <br /> <br />The City has issued to Ralph's Gun and Pawn (Ralph's), a Minnesota corporation ("Ralphs") a <br />license to operate a pawnbroker business at 6101 Highway 10 NW in Ramsey. <br /> <br />City Code Section 7.13 ("Section 7.13") and Minnesota Statutes regulate pawnbrokers within the <br />City. In January 2008; the City's police department alleged Ralph's was in violation of various <br />provisions of Section 7.13 and sought to have Ralph's pawnbroker's license revoked. Section 7.13 <br />provides for. the. sanction of license suspension and/or r~vocation for proven City Code violations. <br />Revocationmay be only for cause and upon adequate notice and the opportunity to be heard. <br /> <br />By City Council motion on January 22, 2008, the Council authorized the use of a hearing examiner <br />to conduct the required hearing. <br /> <br />Notice of the hearing and its purpose was given to Ralph's and a hearing was held on March 3, <br />2008, at the Ramsey Municipal Center. The Hearing Examiner was Michael Scott. Todd Jardine. <br />appeared pro se on behalf of Ralph's and the City Attorney's office represented the City. <br /> <br />The Hearing Examiner issued his Findings of Fact, Conclusions and Recommendations on April 28, <br />2008. Said Findings et al. were also mailed to Ralph's on that date. <br /> <br />The City Councilmembers have previously received the recommended Findings and the hearing <br />transcript has been made available to City Councilmembers for their review. <br /> <br />The City Council is now being asked to consider the Hearing Examiner's recommended Findings, et <br />al. and to adopt/reject/modify said recommendation. <br /> <br />Enclosure: <br /> <br />Notice of Hearing <br /> <br />Recommendation: <br /> <br />Affirm the Hearing Examiner's recommendation. <br /> <br />Council Action: <br /> <br />Motion to reject/adopt/modify the Findings of Fact, Conclusions and Recommendations of Hearing <br />Examiner Scott dated April 28, 2008 regarding the license issued to Ralph's Gun and Pawn for <br />operation ofa pawnbroker business at 6101 Highway 10 NW, Ramsey, MN. <br /> <br />-81- <br />
