<br />moved for the adoption of the following resolution: <br /> <br />RESOLUTION #08-05-xxx <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #xxxx RELATING TO A REQUEST FOR A <br />AN APPEAL TO STAFF DETERMINATION REGARDING RELOCATION OF DRIVEWAY <br /> <br />WHEREAS, D. Anthony Lee, hereinafter referred to as "Applicant", has properly applied for an <br />appeal to staff's determination regarding the relocation of the driveway on the property generally located <br />at 16685 Gamet Street NW and legally described as following: . <br /> <br />Looyens Addition Lot 1, Block 1, Looyens Add(Subj to Ease as Shown on Plat)Ease to City of <br />Ramsey for RT of Access to 167th Ave NW <br /> <br />(the "Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Applicant applied for a Zoning Permit on May 2, 2008 to construct a fence along 16ih <br />Avenue NW and to construct a driveway on Gamet Street NW. <br /> <br />2. That the Ramsey Planning Division received the request to construct a fence along 16ih Avenue <br />NW and to construct a driveway on Gamet Street NW and discovered that Gamet Street NW is an <br />un-opened, dedicated right of way with no public improvements and the City does not currently <br />maintain this right of way. <br /> <br />3. That the Subject Property currently gains access with an existing driveway on 167th Avenue NW. <br /> <br />4. That the Applicant has stated that the existing driveway is in need of repair and that the upgrades <br />planned to 16ih Avenue will increase the amount of traffic in front of the Applicant's home. <br /> <br />5. That private improvements currently exist on the Gamet Street right of way that were not approved <br />by the City. These improvements consist of gravel and landscape rock with a culvert for drainage as <br />well as storage of a recreational vehicle. <br /> <br />6. That the Ramsey Planning Division denied the request to construct a driveway on Gamet Street NW <br />and approved the request to construct the fence, with restrictions to come into conformance with <br />City Code, and informed the Applicant of the staff's interpretation of City Code on May 2, 2008. <br /> <br />7. That the Applicant properly submitted an appeal in writing on May 7,2008. <br /> <br />8. That construction of Gamet Street is not in the current City of Ramsey Capital Improvements <br />Program (CIP). <br /> <br />9. 'That Subject Property is zoned R-l Rural Developing. <br /> <br />10. That upgrades are planned for adjacent 16ih Avenue NW; however, these upgrades do not include <br />plans to upgrade Gamet Street. ' <br /> <br />-10~ <br />
