<br />May 20, 2008 <br /> <br />We, Darren and Nicole Tillman, being the legal property owners of Lot 11 <br />Block 3 of the Ponds of Ramsey, commonly known as 14420 Northwest <br />Iodine Street, Ramsey, do hereby petition the City Council of the City of <br />Ramsey for a waiver/variance of the building code outlining that <br />structures cannot be built within 10 feet of a property line on an easement. <br /> <br />We have a proposed plan for a deck that would require a small portion of <br />the deck's cantilever overhang into a storm drain easement. The footings <br />of the proposed deck would not be within the protected easement area, <br />however the cantilever (the elevated deck boards) would hang over into <br />the easement on the "catwalk" of the wrap around part of the deck. The <br />portion of overhang into the easement would be at most 16 inches and <br />would gradually decrease to have no portion of the "main" deck into the <br />easement. This span would be approximately 16 feet. Please reference the <br />attachment to this petition for a visual explanation, as the circumstance is <br />difficult to describe well in words. <br /> <br />t <br /> <br />The reason for our request is dueto the following unique circumstances: <br />1) The lot shape is .irregular which causes a portion of the deck <br />cantilever to fall within the easement, while the majority of the deck <br />structure would be within City Easement Codes. (The footings <br />would not fall within the easement line.) <br />2) There is a steep grade on the affected side of our home not allowing <br />us to modify our deck plan. <br />3) Modification in the deck plan will bear financial hardship for us, as <br />the original home builder prepared the home for this deck plan <br />(walk around) with the deck boards already secured to the domicile. <br />If we are unable to move forward with the deck design and build we <br />will need to remove these deck boards and re-side an entire side of <br />our home. <br /> <br />Should the City Council grant our request, we as property owners <br />understand that we are wholly and solely responsible for damages that <br />may occur to the deck arising from the City's need to access the storm <br />drain utility ~at may be within the ei,ent. _ .
