That would be true for a very short distance - in fact just for inches. As I mentioned to you, the property <br />on that side of the home has a steep grade. The deck boards would rapidly increase to be of a distance of about 8 feet <br />from the ground. I think that is a relevant fact to further support my case. As I mentioned, there are a number of <br />extenuating circumstances such as the irregular lot shape and grade of the property where the easement is that should be <br />considered. The probability of a piece of equipment not being able to do the digging as it is intended to do is increased <br />given that fact.
