<br />Case # ~ <br /> <br />REQUEST FOR APPEAL FROM CITY STAFF'S DETERMINATION <br />REGARDING DRIVEWAY RELOCATION; <br />CASE OF D. ANTHONY LEE <br />By: Tim Gladhill, Management Intern <br /> <br />Background: <br /> <br />On May 2, 2008, D. Anthony Lee submitted a Zoning Permit Application to construct a <br />fence and driveway on the property located generally at 16685 Garnet Street NW. The <br />applicant desired to relocate the driveway from existing 167th Ave NW to Garnet Street <br />NW, an un-opened (no public improvements), dedicated right-of-way. Staff denied the <br />request to relocate .the driveway, but approved the request to construct a fence, with <br />restrictions. <br /> <br />The following items are included in your packet, for your information: <br /> <br />1) Site location map <br />2) Letter from applicant requesting appeal <br />3) Proposed site layout <br />4) Certificate of Survey for Subject Property <br />5) Photos of the right-of-way taken May, 2008 <br />6) Proposed Findings of Fact <br /> <br />Notification: <br /> <br />A Public Hearing is not required for a Zoning Permit Appeal. <br /> <br />Observations: <br /> <br />As Council is aware, 167th Avenue is scheduled for upgrades to MSA standards. The <br />applicant has stated a desire to relocate his driveway from 167th Avenue to Garnet Street <br />NW due to a perceived increase in traffic. However, Garnet Street is not in the five year <br />Capital Improvements Program (CIP) and is not planned for upgrades as part of the 16ih <br />Avenue project. It would appear that this road would be constructed either when parcels <br />to the south develop or when the two current property owners with frontage on Garnet <br />Street petition to construct the road. The applicant proposes to keep one access, without <br />a driveway, onto 167th Avenue to access the accessory structure on the subject property. <br />The City Attorney has stated that the City is not obligated to provide access to an un- <br />opened right of way. <br /> <br />The reason the applicant has stated the desire to relocate the driveway to Garnet Street <br />due is due to the amount of traffic increase the applicant expects due to the planned <br />upgrade of 167th Avenue.
