The court noted that a p~oper <br />equal protection claim required a party to claim that the government <br />treated similarly situated persons differently. The court found that the <br />Brauns failed to allege any specific examples of similarly situated in- <br />dividuals with situations where the proposed rezoning was similar in <br />scale or impact. <br />Finally, the court concluded that the Brauns' claim that the rezone <br />denial and zoning ordinance violated federal law (42 US.c. ~ 1983) <br />protecting rights secured by federal law also failed.
