City of Somerville, 451 <br />Mass. 80, 883 N.E.2d 933 (2008) <br /> <br />MASSACHUSETTS (04/04/08)-The Massachusetts Bay Transportation <br />Authority (META) was a political subdivision of the Commonwealth of <br />Massachusetts. It had the power to provide mass transportation services. <br />It operated and managed facilities used in connection with those services. <br />The MBTA erected advertisements on its facility in Melrose, Massa- <br />chusetts. The MBTA did not apply to Melrose for permits to erect those <br />advertisements. Nor did it apply for permits from the Outdoor Adver- <br />tising Board (OAB), the administrator in Massachusetts of the federal <br />Highway Beautification Act of 1965. The OAB determined that it did <br />not have jurisdiction over the MBTA's advertisements on the MBTA's <br />Melrose- facility.
