<br />Councilmember Dehen stated that he cannot fathom that someone can build a structure and not <br />reasonably understand that there needed to be permits pulled. He stated that he would like to <br />follow up on this because it does not seem like an "oops" situation, but a very deliberate attempt <br />to not follow the proper procedures. <br /> <br />Councilmember Look stated that this situation came to the City's attention because of the fire, <br />but now he would like to know how the City knows that the living quarters were built to code. <br /> <br />Fire Chief Kapler stated that the fire had something to do with a plug in heating element and was <br />in a different building. <br /> <br />Community Development Director Miller stated that the Building Official has gone through the <br />. site and the owner has agreed to do what he needs to, to bring it up to code. <br /> <br />Councilmember Olson asked if the City could pursue back permit fees, but would like to make <br />sure that it doesn't follow the property, just the prior owners. <br /> <br />Motion by Councilmember Olson, seconded by Councilmember Dehen, to adopt Resolution #08- <br />05-082 to approve the final plat of Kings Ranch Estates contingent upon compliance with City <br />Staff Review Letter dated may 9, 2008 and the Developer entering into a development agreement <br />with the City. <br /> <br />Motion carried. V oting Yes: Mayor Pro Tern Elvig, Councilmembers Olson, Dehen, Jeffrey, <br />Look, and Strommen. Voting No: None. Absent: Mayor Gamec. <br /> <br />There was a Consensus of the Council to investigate possible double permitting or prosecution of <br />the former property owners. <br /> <br />Case #5: <br /> <br />Adopt Ordinance to Amend Regulations Regarding Section 9.11.04 (Home <br />Occupations) of the City Code; Case of City of Ramsey <br /> <br />Assistant Community Development Director Frolik stated that this ordinance was introduced on <br />April 22, 2008, and Council directed staff to make a few amendments. She reviewed the <br />amendments recommended by Council. <br /> <br />Councilmember Look stated that page 194 mentions the fee, but the Council relies on staff to <br />help the Council determine this fee, and that hasn't happened. <br /> <br />Assistant Community Development Director Frolik stated that staff has not yet had a chance to <br />discuss fees, but there is time before the ordinance takes effect. to come up with the <br />administrative form and set the fee. She stated that the ordinance will take effect 30 days after it <br />is published in the newspaper. <br /> <br />City Council! May 13, 2008 <br />Page 10 of 17 <br />
