<br />CONSIDER AMENDING SUBSECTIONS 2.5 <br />AND 4.5.5 OF THE CITY'S CHARTER <br /> <br />By: William K. Goodrich, City Attorney <br /> <br />Background: <br /> <br />CASE#~ <br /> <br />At the Charter Commission's meeting on April 17, 2008, the Commission again discussed <br />amending Subsection 4.5 .5 (office vacancy when less. than eight weeks prior to primary election) in <br />order to have it reflect the establishment of the primary election system for the City. Enclosed again <br />is draft language for your consideration based on the April 17, 2008 meeting discussion. Also <br />enclosed is Subsection 2.5 (Vacancies) which subsection was by consensus approved at the <br />Commission's April 17, 2008 meeting. A determination of whether an elected councilmember can <br />legally be seated immediately after the November election has not been made. Every effort will be <br />made to have a ruling on this legal issue by the meeting.
