Background:
REPORT ON 160TH AVENUE MEDIATION SETTLEMENT
By Steven Jankowski, City Engineer
CASE #
The Trappers Ridge , subdivision consists of a two lot subdivision which was platted at the
terminus of 160 Lane in 2004. The westernmost 420 feet of 160 Lane has not been
constructed, however a 66 foot road easement existed over the two properties at the end of the
paved street. It was subsequently determined that this easement was not specifically dedicated to
the City. As a result the City purchased the right of way from these properties and the Trappers
Ridge lot property owner constructed his driveway through the right of way to obtain ingress, and
egress to his lot.
Beginning in the summer of 2005 staff had received phone calls from the property owners at the
end of 160 Lane disputing the use of the drive access that had been constructed within this right
of way. In an effort to resolve the neighborhood dispute surrounding this situation, the neighbors
agreed to enter into mediation with Anoka County Mediation Services. Notice was delivered to
the participants of the mediation that the case has been settled with the consensus that the City
should maintain the right of way. A copy of the dispute settlement agreement is attached.
Recommendation:
Gerald Bauer Jr., owner of the Trappers Ridge lot, is agreeable to performing a portion of the
required improvements to comply with the mediation agreement. Staff hereby recommends that
the following be performed by the Public Works Department:
a) The right of way of cleared of trees 18 feet on each side of centerline.
b) Stumps be grubbed and the roadway graded to a width of 36 feet.
c) Sign both sides of the roadway for No Parking
Mr. Bauer has agreed to:
a) Place a 20 foot wide, four inch lift of class 5 in the path graded by the Public Works
Department
b) Pave a 12 foot wide lift of bituminous pavement centered within the 20 foot based area
Financial Impact:
The financial impact of this work is estimated to be $3,774 with a detailed breakdown as
follows:
) Tree removal will be done by our correctional workers
