CONSIDER REQUEST FOR EASEMENT VACATION FOR 5939151 LANE <br />By Steven Jankowski, City Engineer <br />Background: <br />The City has received a request from Mr. Steven Croteau at 5939 151 Lane for the vacation of a <br />portion of the drainage and utility easement located on his property at the above address. He has <br />applied for an easement vacation which is being administered through the Community <br />Development .Department. The purpose of his case is to address the technical aspects of this <br />request. <br />Public Works Director Olson met on site to review the local topography on the rear of the lot <br />where Mr. Croteau would like to construct a storage shed. Attached to this case is a copy of the <br />portion of the subdivision plat illustrating the drainage and utility easement which appears to <br />have been drawn to protect the wetland area on the northwest corner of his property along with a <br />swale running parallel with the north property line to drain another low pocket on the property to <br />the east A sketch of the area for the shed to be located along with the portion of the easement to <br />be vacated is also attached: It was apparent from the site visit that the location on which Mr.. <br />Croteau wishes to construct the shed is substantially higher than that of the wetland and drainage <br />swale. <br />Recommendation: <br />It is staff's opinion that the original delineation of the drainage and utility easement on the <br />subject property was delineated to protect wetland and the drainage swale, but was simplified by <br />encompassing these two elements with two bearing lines to describe the easement. It is staff <br />recommendation that the proposed easement vacation be allowed. <br />Action: <br />Motion to recommend to City Council support for vacation of the easement pending the results <br />of the required public hearing. <br />Reviewed by: <br />Director of Public Works/Principal City Engineer <br />City Attorney <br />PW: 05/20/08 <br />
