Public Hearing <br />REQUEST FOR EASEMENT VACATION AT 5939151 LANE <br />CASE OF FROM MR. STEVEN CROTEAU <br />By Steven Jankowski, City Engineer <br />CASE # <br />Background: <br />The City has received a request from Mr. Steven Croteau at 5939 151 Lane for the vacation of a <br />portion of the drainage and utility easement located on his property at the above address. The <br />following items are included for your information: <br />Notification: <br />a) Site location map <br />b) Exhibit of underlying easements to be vacated <br />c) Proposed Ordinance <br />Observations: <br />Publication of the request for considering the vacation has been published in the official City <br />newspaper as required by law. In accordance with State Statute, City Staff attempted to notify <br />property owners within 350 feet of the subject property of the public hearing to vacate easements. <br />The mailed notices were returned due to inaccurate addresses. Because of this it is recommended <br />that Council convene the public hearing on June 10 and continue it to June 24 when the Vacation <br />Ordinance will be eligible for adoption. <br />Public Works Director Olson met with the petitioner on site to review the local topography on <br />the rear of the lot where Mr. Croteau would like to construct a storage shed. The drainage and <br />utility easement appears to have been drawn to protect the wetland area on the northwest corner <br />of this property along with a swale running parallel with the north property line to drain another <br />low pocket on the property to the east. It was apparent from the site visit that the location on <br />which Mr. Croteau wishes to construct the shed is substantially higher than that of the wetland <br />and drainage Swale. It appears that the original easement was prepared by using just two bearing <br />lines as the simplest way to describe the easement. <br />Funding Source: <br />All costs of easement vacation review are the applicant's responsibility. <br />Recommendation: <br />Staff recommends the easement be vacated, contingent upon recording the new easement. <br />
