<br />Councilmember Dehen asked if this would be an administrative ticket rather a criminal process. <br /> <br />Councilmember Elvig stated that he agrees with the concept, but does not think the City should <br />try to handle this administratively and should let the law take care of it. <br /> <br />Mayor Gamec stated that he thinks there is. a general consensus that the Council agrees with the <br />idea. <br /> <br />Councilmember Dehen stated that he did not agree. <br /> <br />Councilmember Look stated that he agrees that there needs to be some language changes made. <br /> <br />Councilmember Dehen stated that he doesn't want to impose criminal or civil liability on <br />someone who doesn't know or "should have" known about this, unless there is evidence to back <br />it up. <br /> <br />4) Age Verification for Liquor Establishments <br /> <br />Police, Chief Way noted that a 2-tier fee structure was adopted for tobacco retailers in February <br />2008.' He stated that the Council had wanted to see the same type of structure for alcohol <br />establ~shments. He stated that it is important to note that "on sale" and "off sale" are different <br />and he feels the "off sale" businesses could be handled similar to the tobacco retailers, but thinks <br />it isn't possible for "on sale". He stated that currently, the City charges $200 for off sale, but <br />effect~ve on January 1, 2008, the State increased this to $380 for off sale. He stated that he <br />would recommend that businesses be given a $100 reduction in this fee if they follow and <br />comply with the 3 bullet items on the handout, in addition to the City requirements. <br /> <br />Councilmember Look asked if businesses that have a tobacco license are also selling liquor. <br /> <br />Police Chief Way stated that there are fewer and fewer selling tobacco because of the new laws, <br />but noted that this is the same system. <br /> <br />Counqilmember Jeffrey asked what the penalty would be if, for example, they didn't ask for his <br />identi:(ication. <br /> <br />Police' Chief Way stated that the City would need to decide that. He stated that many cities have <br />a requjrement for checking identification on people who appear to be 30 years old or less. <br /> <br />There was a Consensus of the Council to move this issue forward. <br /> <br />5) Community Center Focus Groups/Task Force <br /> <br />Management Intern Gladhill stated that staff is in the process of forming focus groups that will <br />eventually lead to a task force. He reviewed the groups and organizations that they were looking <br />to get the initial feedback from: Residents/Appointed Officials; Seniors; Community <br /> <br />City Council Work Session I June 3, 2008 <br />Page 12 of 16 <br />
