<br />PUBLIC HEARINGS/BOARD BUSINESS <br /> <br />Case #1: <br /> <br />Ratify the Planning Commission Action of January 3, 2008 to Appoint Chair <br />and Vice Chair Qf Board of Adjustment <br /> <br />Commissioner Brauer arrived at 7:05 p.m. <br /> <br />Motion by Board Member Cleveland, seconded by Board Member Hunt, to ratify the January 3, <br />2008 motion to appoint Gary Van Scoy as the Chair and Gary Levine as Vice Chair of the Board <br />of Adjustment. <br /> <br />Motion Carried. Voting Yes: Chairperson Van Scoy, Board Members Cleveland, Hunt, Brauer, <br />Cleveland, Hunt, and Levine. V otingNo: None. Absent: Board Member Nixt. <br /> <br />Case #2: <br /> <br />Request for a Variance to Lot Width Requirements in the R~l Residential <br />District for Ebony Woods Addition; Case of Tim Holm <br /> <br />Chairperson Van Scoy closed the regular portion of the Board of Adjustment meeting at 7:06 <br />p.m. in order to conduct the public hearing. <br /> <br />Public Hearin!! <br /> <br />Chairperson Van Scoy called the public hearing to order at 7:06 p.m. <br /> <br />Presentation <br /> <br />Management Intern Tim Gladhill stated Ebony Woods has applied for Sketch Plan review to <br />create three (3) single-family lots in the R-1 Residential District in the Mississippi River Critical <br />Area Overlay District. Minimum lot width for this district for residential parcels is 90'. The lots <br />are proposed to be 80', 80', and 84.5' respectively. <br /> <br />City Code establishes a 90-1'oot lot width for residential parcels in the Mississippi River Critical <br />Area Overlay District. The applicant is requesting a variance to allow for two (2) 80-foot lots and <br />one (1) 84-foot lot. <br /> <br />Staff has forwarded the request on to the DNR, which recommended denial of the request due <br />failure to demonstrate hardship. <br /> <br />The Planning Commission may recall that after significant discussion, the applicant's most recent <br />request to develop six (6) twin-home units (three two-unit structures), was ultimately denied by <br />the City Council. The original application by Mr. Holm was submitted on April 6, 2006 and was <br />for eight townhome units (two four-unit structures). The applicant was directed several times by <br />City Council to submit revised plans and building elevations. <br /> <br />The proposed plat has gone through several renditions since the initial application date in April, <br />2006. Ultimately, the City Council decided that a re-zoning to P.U.D. was not appropriate and <br />re-zoned the property to R-l Residential from B-2 Business. <br /> <br />Board of Adjustment/April 3, 2008 <br />Page 2 of5 <br /> <br />-30- <br />
