<br />plat meets the open space and impervious surface requirements with 81 % open space and 19% <br />impervious surface. It is also noted that the maximum structure height in the Overlay District is <br />35 feet. Staff has forwarded the plat on to the Minnesota Department of Natural Resources for <br />comment. Per City Code requirements, the variance to lot width has been certified by the DNR <br /> <br />Additionally, the District requirements state that the minimum lot width for residential parcels <br />shall be 90 feet. A variance to minimum lot width has been approved by the Board of <br />Adjustment. The proposed plat shows two 80 foot wide lots and one 84 foot wide lot. All three <br />lots exceed the minimum lot area requirement in the district. <br /> <br />The development will receive public access from Ebony Street, a dedicated and improved public <br />street. Currently, two services for municipal sewer and water exist to the property. These two <br />services were installed upon the applicant's request. At that time, only two services were needed <br />to service two townhome units proposed on a previous proposed plat that was ultimately denied. <br />If this request is appro.ved, a third service will need to be installed at the cost of the developer. <br />The proposed Final Plat includes three services for the proposed plat. <br /> <br />The landscaping plan is generally acceptable with revisions outlined in the staff review letter. A <br />revised landscaping plan will be required prior to recording of the plat. <br /> <br />On June lO, 2008, Council met to discuss the request for Final Plat Review for the proposed <br />subdivision. Council directed the applicant to submit architectural renderings of the proposed <br />homes to include three colors and two different building materials for each home, as well as <br />varying front yard setbacks for each. City Code does not require site plan review or architectural <br />renderings for single-family homes. Setting minimum architectural standards in a single family <br />plat is the choice of the developer. A variance to lot width has already been approved by the <br />Board of Appeals, and therefore additional stipulations cannot be added to this variance. As with <br />other single family developments in the City, the applicant provided plans to verify that each lot <br />can accommodate a building pad that meets all setbacks. The R-l:MUSA District has a 30' <br />minimum front yard setback. The City has not required staggering front yard setbacks in other <br />. single family plats. The builder can choose the setback assuming that the minimum setback <br />requirement is met. <br /> <br />The applicant has stated that he the developer and will not be building the homes. The lots will <br />be sold to builders or homeowners. Furthermore, the applicant has stated that he was under the <br />impression, based on the October 9th, 2007 City Council minutes, that single family homes do <br />not come before the Council for site plan approval. Minutes from that meeting have been <br />included in the packet. However, the applicant has stated that he would be willing to place a <br />covenant on each parcel to require the requested architectural elements and setback variations <br />requested by City Council. <br /> <br />Recommendation: <br /> <br />The Planning Commission met on April 3, 2008 to provide feedback regarding the Sketch Plan <br />for the proposed plat. Staff recommends approval of the Final Plat, contingent upon compliance <br /> <br />-8- <br />
