<br />Mr, Bauer stated that there is a one lane driveway that two people use. He stated that there has <br />been some animosity and if two cars meet in the middle, there is no clear direction on who will <br />back up and get out of the way. He stated that he went through all the proper channels at the <br />beginning of this process, has over $10,000 into this and this is his primary driveway, so he <br />doesn't think he should be the one to back up. <br /> <br />Chair Elvig stated that he agrees that it is a good idea to have City Attorney Goodrich weigh in <br />on this situation. He noted that he will be coming for a different meeting later tonight and <br />perhaps he could come earlier to give an opinion. <br /> <br />City Administrator Ulrich stated that he would give City Attorney Goodrich a call to see if he <br />can arrive earlier, <br /> <br />Mr. Bauer stated that he thinks the attorney will need to do some research into the situation and <br />won't be able to give an opiniontonight. He stated that he wouldjust like it solidly stated in the <br />minutes that this issue needs to be reviewed soon. He stated that he will leave his name with City <br />Administrator Ulrich in case the attorney had questions for him. <br /> <br />Case #4: <br /> <br />Receive Information on Andrie Street /164th Lane Homeowners Association <br />Survey and update on IP 08-06 <br /> <br />City Engineer Jankowski explained that at the last Council meeting,. the street maintenance <br />projects were approved, but the Audrie Streetl164th IF 08~06 was to be an alternate bid. He <br />stated that a group of homeowners has put together a petition stating that they would like the <br />City to consider a larger reconstruction project that includes curb and gutter rather than just an <br />overlay. He stated that since he put together the staff report for tonight's meeting, he has <br />received information on the alternate bid situation. He stated that because the price of oil is so <br />volatile, the oil companies. are only providing daily quotes that are only good for 2 weeks, which <br />would be a problem with the alternate bid because the work could be awarded as late as <br />September 7, 2008. He stated that the City could index to a particular refinery cost or rebid at a <br />later date which would involve some lead time, but the bottom line is that the City won't know <br />the cost ofthis project until sometime in the future, when the project is awarded <br /> <br />Councilmember Dehen asked if the City was following the proper procedure. <br /> <br />City Engineer Jankowski stated that the neighborhood can petition against the overlay, which did <br />not happen, because they all acknowledge that something should be done to the road.. He stated <br />that the question is whether it should be more than an overlay. He stated that if the City wants <br />the larger project, there is a definite procedure that needs to be followed, a feasibility study, a <br />public hearing, a 60 day waiting period. He stated that this is why if the larger project is <br />selected, it could not happen until the 2009 construction season. He stated that Bill Kingston has <br />a petition to present to the Committee, but the piece that was missing is the cost information. He <br />stated that there may be some properties that were included for the overlay ptoject, but wouldn't <br />be with a reconstruction, so there needs to be a discussion about who will be assessed and the <br />amount of the assessment. <br /> <br />Public Works Committee / May 20, 2008 <br />Page 4 of9 <br />
