<br />CASE # <br /> <br />'1 <br /> <br />REVIEW AND ACCEPT LEASE AGREEMENT FOR A TELECOMMUNICATIONS <br />TOWER IN ALPINE PARK: <br />CASE OF T -MOBILE CENTRAL, LLC <br />By: Breanne DaInes, Associate Planner <br /> <br />Background: <br /> <br />On January 8, 2008, the City Council approved the conditional use permit to construct a <br />telecommunications towerin Alpine Park. At this point, T-Mobile would like to move forward to <br />construct the approved tower. The Lease Agreement is included in your packet. <br /> <br />Observations: <br /> <br />The lease is proposing to collect $18,000.00 per year to be dedicated to the Park Trust Fund for <br />the specific improvement of Alpine Park (this was approved as part ofthe conditional use permit <br />resolution). Furthermore, the City shall collect 10% of all revenue that T-Mobile generates on the <br />tower through Lease Agreements with other telecommunications companies. Any taxes owed on <br />the Leased Premises will be paid by T-Mobile. <br /> <br />The lease will be for a five-year period, with the option for 3 additiona15-year periods, for a total <br />of 20 years. The rent will be adjusted at the end of each term, based on the increase in Consumer <br />Price Index over that period. <br /> <br />Funding Source: <br /> <br />The applicant is responsible for all costs associated with processing the land use application and <br />reviewing the Lease Agreement. . <br /> <br />Recommendation: <br /> <br />Staff recommends approval of the Lease Agreement with T-Mobile. <br /> <br />Council Action: <br /> <br />Motion to approve the Lease Agreement, dated June 17,2008, betweenT-Mobile USA and the <br />City of Ramsey for the lease of a 40 foot by 40 foot portion of land in Alpine Park (and <br />associated access easements) for the construction of a telecommunications tower that will be <br />constructed in accordance with the approved conditional use permit. <br /> <br />Review Checklist: -/ ., <br />City Administrator P ~ .~ L ~ <br />Assistant Community Development Director <br />City Attorney <br />Finance Officer <br /> <br />'A) <br /> <br />CC: 6.24.08 <br /> <br />-257- <br />
