<br />CASE # .CJ <br /> <br />INTRODUCE ORDINANCE AMENDING SECTION 9.11.04 <br />(ACCESSORY STRUCTURES) OF THE <br />ZONING CHAPTER OF CITY CODE <br />By: Breanne Daines, Associate Planner <br /> <br />Background: <br /> <br />Staff is bringing forward some minor revisions to Section 9.11.04. (Accessory Structures) of City <br />Code. There are two housekeeping items, and one policy shift that is proposed. <br /> <br />Attachments: <br /> <br />I) Proposed Ordinance <br />2) Draft minutes from the Planning Commission public hearing on June 5, 2008 <br /> <br />Observations: <br /> <br />The two housekeeping items staff would like to bring forward relate to the chart located within the <br />accessory structure section of City Code. This chart indicates how much square footage is allowed <br />and the architectural details required for accessory structures, both based on property size. This <br />chart needed to be revised to more clearly layout which architectural standards apply in each. <br />category. Secondly, the chart had been revised in 2006 to create a category for 1.5 to 2.49 acre <br />parcels; It was subsequently discovered that many ofthe.standards relating to size do change at the <br />2-acre threshold. Therefore the 1.5 to 2.49 acre category was split to be more clear with respect to <br />performance standards. Neither ofthese two changes will change interpretation or policywithinthe <br />City Code. <br /> <br />The last item addressed in this ordinance relates to accessory structures 120 square feet or smaller <br />(subd.4.m). After discussion among the building and planning divisions, it was determined that <br />these smaller structures should be included in the overall total square footage allowed within each <br />category. The reasoning is that as the Code reads currently, a property owner could install multiple <br />small sheds on the property without regard to the number or square footage allowed. To mitigate <br />the effect of including accessory buildings less than 120 square feet, staff proposed to increase total <br />accessory space allowed on all parcels (one to ten acres) by 200 square feet and increase the number <br />of accessory building allowed by one. This will allow staff to subject all accessory structure space <br />to the space restrictions. <br /> <br />The accessory structure section establishes construction standards that are intended to. prohibit <br />dwellings in garages. Staff also included a refined definition of accessory apartment to aid in the <br />interpretation of the Code. <br /> <br />Funding Source: <br /> <br />City Code amendments are processed with Staff time. <br /> <br />Recommendation: <br /> <br />Staff recommends introducing the ordinance. The Planning Commission held the public hearing on <br />June 5, 2008, and recommended that the Council approve the ordinance. <br /> <br />-301- <br />
