Motion by .~.mrmss~oner Hendriksen and seconded by Commissioner Holland to discuss Case #4 <br />prior to Cast~ ~3 be~ cause there are persons in the audience because of the subject of Case #4. <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioner Hendriksen, Holland, Deemer, <br />LaDue and ~l'~rry.~ Voting No: None. Absent: Commissioner Thorud. <br /> <br />Case #4: ~ Pr~oposed Ordinance amending Section 9.11.19, Subd. 3, Paragraph <br /> · b iof the City Code entitled "Adult Uses-Principal" <br /> <br />Commissionqr I-I~ ndriksen stated that when Mr. Tigue spoke at the public hearing, he eluded to <br />events that halve recently occurred and Commissioner Hendriksen inquired what these events might <br />be. <br /> <br />Zoning Admi~isLl'ator Frolik replied that the City Code states that any non-conforming adult use is <br />given an anidrtizStion period to relocate and Mr. Tigue requested that since there may not be any <br />adverse sec0~da~ effects because of the Adult Bookstore, this Commission should recommend <br />deleting the ¢!ause pertaining to amortization. <br />Mr. Larry H¢lmberg, owner of the Adult Bookstore, stated he fully endorses the Commission <br />approving th~amendment relating to the number of adult uses per site. <br /> <br />Ms. Frolik s~atefl, this amendment would give Mr. Holmberg the fight to relocate his existing <br />business intOone, building versus having to find three buildings. <br /> <br />Motion by C0m~ssioner Deemer and seconded by Commissioner LaDue to recommend that City <br />Council adopt the proposed ordinance amending Section 9.11.19, Subd. 3, Paragraph b of the <br />City Code e~nfitled "Adult Uses-Principal". <br /> <br />Further dis~tissi°n: Commissioner Hendriksen inquired what is meant by multiple adult uses to <br />which Ms. ~roli!¢' replied adult magazines, books, videos, etc. All are separate adult uses and <br />currently haye to have separate sites. Chairperson Bawden inquired about the repeal of <br />amortization/ Ms. Frolik informed him that this would be a further amendment to the Zoning <br />Chapter and ~e Planning and Zoning Commissioner or the City Council could initiate that change. <br />The Planning and Zoning Commission stated they want the minutes to reflect the request so City <br />Council is aWare!of it; however, the Commission does not want to initiate it. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, LaDue, Holland and <br />Terry. Voting Nb: Commissioner Hendriksen. Absent: Commissioner Thorud. <br /> <br />Case #3: : Project Status Report <br /> <br />The Planning and Zoning Commission reviewed and discussed the Project Status Report. <br />Commissi°ngr Deemer stated that the City Engineer had not commented on the Commission's <br />concerns regarding the street lights. He mentioned that the Commission had still not been allowed <br />the privilege .~o ~view in-house projects.
