<br />Councilmember Jeffrey introduced the following resolution and moved for its adoption: <br /> <br />#08-05 -092 <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF FEE TITLE TO CERTAIN <br />PROPERTY AND PERMANENT EASEMENTS NECESSARY FOR THE <br />CONSTRUCTION OF A W ATERMAIN LOOP AND TRAIL CONNECTION <br /> <br />WHEREAS, the City finds it necessary and in the public interest to construct a <br />watermain loop and trail connection to serve the public utility and transportation needs of the <br />City's residents and such improvements were authorized as project #08-29 by the City Council <br />on May 13,2008 (the "Public Improvement Project"); and <br /> <br />WHEREAS, the Public Improvement Project is identified on the City's master municipal <br />utility and transportation plans; and <br /> <br />WHEREAS, the City has acquired by direct negotiation certain rights of way necessary <br />for the Public Improvement Project; and <br /> <br />WHEREAS, it is necessary to acquire fee title to certain other parcels as well as certain <br />other permanent easements; and <br /> <br />WHEREAS, the legal descriptions of the permanent easements necessary to be acquired <br />are as follows: <br /> <br />see attached EXHIBIT A <br /> <br />(the "Permanent Easements"); and <br /> <br />WHEREAS, the legal description of the parcel to be acquired in fee title is as follows: <br /> <br />Lot 2, Block 6 PELTZER ADDITION according to the recorded plat thereof Anoka County, <br />Minnesota <br /> <br />(the "Fee Title Parcel"); and <br /> <br />WHEREAS, the Fee Title Parcel, and the Permanent Easements are all hereinafter <br />collectively referred to as the "Property Interests"; and <br /> <br />WHEREAS, the City declares that it is in the public interest to acquire the Property <br />Interests above described; and <br /> <br />WHEREAS, the City has authority to acquire the Property Interests for the Public <br />Improvement Project by eminent domain pursuant to Minn. Stat. Chapter 117; and <br /> <br />RESOLUTION# 08-05-092 <br />
