<br />CASE # <br /> <br />REQUEST FOR A VARIANCE FOR PLACEMENT OF AN ACCESSORY <br />STRUCTURE CLOSER TO THE FRONT PROPERTY LINE THAN THE <br />PRINCIPAL STRUCTURE;CASE OF JOHN IVES . <br />By: Tim Gladhill, Associate Planner <br /> <br />Background: <br /> <br />Section 9.11. 02 of the Ramsey City Code states that no accessory structure shall be constructed <br />closer to the front property line than the p~incipal structure. The applicant is proposing to <br />construct an accessory building closer to the front property line than the principal structure on the <br />property located at 14630 Bowers Drive NW. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site survey <br />c ) Architectural Elevations <br />d) Letter from Applicant outlining request <br />e) Proposed Findings of Fact <br />f) Proposed resolution granting approval of Variance <br />g) Resolution #97-08-189 granting approval ofVarian~eto Ordinary High Water Setback <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff attempted to send notification of the variance request and <br />public hearing to all owners of property within 350 feet of the Subject Property. <br /> <br />Observations: <br /> <br />The subject parcel is approximately 0.85 acres in size, zoned R-l Single Family, and is in the <br />Mississippi River Critical Area Overlay District. City Code has established a 40-foot front yard <br />setback and a 200 foot setback from the ordinary high water (OHW) line for residential parcels in <br />the Mississippi River Critical Area Overlay District. Placing an accessory structure in the rear of <br />the property could be considered in conflict with the Overlay District intent to preserve open <br />space along the river. The principal dwelling is located 138 feet from the front property line. The <br />proposed detached accessory building will be approximately 43 feet from the front property line. <br /> <br />The site plan submitted reveals the property is significantly covered by mature tree growth and <br />bordered by the Mississippi River. A variance has previously been approved for the parcel which <br />restricts to allow encroachment into the OHW setback. The approved variance states that no <br />additional structures shall be constructed encroaching on the OHW setback. Finally, the <br /> <br />1 <br />
