Two-story accessory buildings shall not be permitted on properties less <br />than two (2) acres in size. A conditional use permit shall be required <br />for two-story accessory buildings on properties that are two (2) acres <br />or greater in size. <br />No part of an accessory building shall extend into a drainage and <br />utility easement or any required setback. <br />k. Any accessory building proposed to be within five (5) feet, overhang <br />to overhang, of the principal building shall either be made structurally <br />a part of the principal building or the wall and soffit area of the <br />accessory building that is within five (5) feet of the principal building <br />shall be constructed to a one (1)-hour fire rating. <br />1. Accessory Building Location. <br />1. On lots two (2) acres (87,120 square feet) or greater in size, the <br />detached accessory building may be located nearer the front <br />property line than the principal building provided the following <br />criteria are met: <br />a. The placement of the detached accessory building maintains <br />compliance with the standard front yard structure setback <br />requirement for the respective zoning district; and <br />b. The exterior materials,used on the detached accessory building <br />match those of the principal building on the subject property; <br />and <br />c. The accessory building is designed with soffit, fascia and eave <br />overhang; and <br />d. The accessory building does not exceed the height of the <br />principal building or twenty-two (22) feet, whichever is less. <br />2. On lots less than two (2) acres (87,120 square feet) in size, the <br />accessory building shall be located in the side or rear yard and <br />shall not be located nearer the front property line than the principal <br />building on that lot, unless a variance is obtained. This provision <br />shall not apply to attached garages that maintain compliance with <br />the applicable front yard setback requirement. <br />Front, side and rear yard accessory building setback requirements <br />are outlined in Section 9.20.11 (R-1 Residential District) Subd. 4 <br />(R-1 Bulk Standards). <br />• rn.
