CONSIDER POLICY FOR CONSTRUCTION USE OF SIDEWALKS IN R .IYISEY TOWN
CENTER
By: Leonard Linton, Civil Engineer II
Background:
The Following information was presented at the June 17, 2008 Public Works Committee meeting. The
committee asked that this case be placed on the regular Council agenda for discussion.
Ramsey Town Center was designed as a pedestrian friendly project. Some of the critical elements are
buildings in close proximity to,the property line, sidewalks from back of curb to the front of the building
and planting beds in the sidewalks. These elements have been installed along Sunwood Drive with the
retail center, two office buildings and Municipal Center, The City Council awarded bids for
construction of the sidewalks and planters along the south side of Sunwood Drive from Zeolite Street to
the Municipal Center and along the north side of the street from the Municipal Center east to Ramsey
Boulevard. The approval of the project included a request for development of a policy regarding
construction adjacent to the new streetscape.
Staff has contacted several cities that have similar streetscape environments, We did not find a defined
policy; however, all respondents indicated that their agreement with the developer includes a provision
for replacement of all damaged sidewalk resulting from construction activities,
Staff has outlined the following components that could be incorporated in a policy or included as
standard language in development agreements for projects adjacent to the new streetscape. These
elements include:
• Take pictures of the sidewalk before any construction activity commences.
• Require an escrow to cover replacement of the sidewalk plantings and features if damaged
during construction.
• Include replacement of damaged features in the Development agreement.
• Contact Connexus and request the light poles adjacent to the proJect be removed during
construction.
• Install silt fence or construction barrier around the planting beds to prevent compaction.
CASE # 5
Incorporating these requirements into the basic development agreement for Ramsey Town Center would
be relatively easy. Development of a formal policy would also be relatively easy. The decision before
the Committee relates to the level of formality desired for addressing the future construction adjacent to
the .streetscape.
Staff has attached copies of the proposed development agreement revision and the policy for review and
discussion.
—181—
