CS-U4 -9897 <br />SETTLEMENT AGREEMENT <br />AS TO EMINENT DOMAIN <br />PARCEL NO.2- DUSI3ABEK <br />IN THE MATTER OF THE CONDEMNATION O.F CERTAIN LANDS IN THE <br />CITY OF RAMSEY, COUNTY OF ANOKA, STATE OF MINNESOTA, FOR <br />STREET, DRAINAGE, AND UTILITY IMPROVEMENT PURPOSES <br />This Settlement Agreement is made and entered into by and between Respondents Steven <br />L. Dusbabek and Christy J. Dusbabek (collectively "Dusbabek") and the City of Ramsey, <br />a Minnesota rnunicipal corporation (the ''City" <br />WHEREAS. The City has commenced an eminent domain proceeding against the <br />property of Dusbabek for the purpose of acquiring a permanent easement for right of way <br />for roadway purposes, and the parties have agreed to a settlement which settles all <br />outstanding issues between them, <br />NOW, THEREFORE, in consideration ot'the mutual covenants contained in this. <br />Agreement: <br />1. Payment for Damages. The City shall pay a total sum of S4I,550.00 to Respondents <br />to settle this matter. The City has paid $15,100.00 already to the Respondents as a <br />"quick take" payment. Therefore, the City shall now mail a check in the amount of <br />$26,450.00 to the office of Leland J. Frankman, Respondent's attorney, made <br />
