A swimming pool or spa may not be located closer than four (4) feet to the principal structure located on the parcel where the swimming pool or spa is to be constructed. 3. No swimming pool or spa may be constructed within twenty (20) feet of any portion of an on-site sewer system or any private water well. 4. No person shall build, construct, locate or install a swimming pool and walkway.or spa within any easement. b. Fencing 1. Temporary Fencing. During the construction of any in-ground swimming pool or spa, the construction area must be secured with a portable fence which is not less than four (4) feet in height. (a) Temporary fencing shall be flush with the ground and securely anchored. (b) Supportive posts shall be placed no more than eight (8) feet apart. 2. Permanent Fencing. 1. All in-ground swimming pools and above-ground swimming pools with a sidewall height less than four (4) feet must be completely enclosed by a permanent fence or wall of a non- climbing type, which has no external handholds or footholds, so as to be impenetrable by toddlers. Chain link fence may be used. The entire enclosure must be at least four (4) feet in height. The opening between the bottom of the fence and the ground or other surface shall not be more than three (3) inches.
