Case# <br />ADOPT ORDINANCE AMENDING SECTION 5.08 (PUBLIC NUISANCES) OF <br />CIiAPTER 5 OF CITY CODE: <br />CASE OF CITY OF RAMSEY <br />By: Breanne Dalnes, Associate Planner <br />Background: <br />Since revising Chapter 5.08 last. year, City Staff has found the definition of "Inoperable <br />Vehicle" difficult to explain and challenging to interpret. The proposed ordinance will not <br />change the definition. of "Inoperable Vehicle" but will re-write it so to be less complicated. <br />The existing defnition is as follows: "any motor vehicle which cannot be driven or propelled <br />under its ov-nl power upon demand in its existing condition; or which cannot be driven or <br />propelled under its own power in a safe manner because of its wrecked, junked, or partially <br />dismantled condition. at the time of inspection and/or abatement; or which does not have <br />attached to it current license plates, tabs, or proof of liability insurance, as required by State <br />law." This definition is cumbersome and provides a high level of confusion when interpreting <br />which conditions must be present in order for a vehicle to be considered "inoperable." <br />The proposed definition will read: <br />Inoperable Vehicle: Any motor vehicle which cannot meet all of the following criteria: <br />1) Tlie vehicle must be able to be driven or propelled under its own power upon demand <br />in its existing condition; and <br />2) The .vehicle must be able to be driven or propelled under its own power in a safe <br />manner (not be wrecked, junked, or dismantled at the time of inspection and/or <br />abatement); and <br />3) .The vehicle must have current licenses plates. and tabs; and <br />4) The vehicle must have current proof of liability insurance, as required by State Law <br />The proposed ordinance is included in your packet. <br />Funding Source: <br />Ordinance amendments are processed witli City Staff time. There are no anticipated. financial <br />impacts of the proposed ordinance. <br />Recommendation: <br />Staff recommends adoption of the proposed ordinance in order to reduce confusion in the <br />interpretation of the definition of inoperable vehicles. <br />Council Action: <br />Motion to waive the reading as required by City Charter and adopt Ordinance #08- to <br />amend. Section 5.08 (Public Nuisances) of City Code. <br />-131- <br />
