CASE # <br />ADOPT ORDINANCE TO AMEND CITY CODE SECTION 9.15 TOWERS; <br />CASE OF CITY OF RAMSEY <br />By: Tim Gladhill, Associate Planner <br />Background: <br />City Council established a moratorium on the construction of cell towers and directed City Staff <br />to review the current regulations and recommend amendments. The moratorium is in effect until <br />September 17, 2008. <br />Observations: <br />The Planning Commission conducted a public hearing on July 10, 2008 regarding ..the proposed <br />amendments to the ordinance. The following is a summary of the proposed changes to the <br />ordinance: <br />• Antennas may be co-located on existing structures in parks; however, no new towers may <br />be constructed within parks. <br />• Height limits have -been adjusted to 100 feet (from 175' in industrial) in all zoning <br />districts; an additiona120' maybe granted if a minimum of two services are co-located on <br />the tower. <br />• The 10 acre requirement for lot size has been eliminated; lot size will be regulated by <br />setback, which is the height of the tower plus 10 feet on residential and public/quasi <br />public parcels. <br />• Setbacks for towers in industrial and commercial areas will default to the underlying <br />zoning district except when adjacent to a residential zone; when adjacent to a residential <br />zone, the setback shall be the height of the tower plus 10 feet adjacent to .the residential <br />zone. <br />• Towers must still be designed to accommodate three users. <br />• Towers will not be allowed to be constructed in the Critical River Overlay District or <br />Town Center Zoning Districts; however, antennas will be allowed. to be mounted on <br />existing structures in these areas. <br />• Towers and antennas will not be allowed to be constructed in the H-1 Highway Business <br />District; this area is reserved for future Highway. l0 alignment and construction of towers <br />would result in added relocation costs. <br />• Towers will be allowed to be constructed the Public/Quasi-Public Zoning District. <br />• Final architectural design of towers is subject to City Council approval. <br />The following items are enclosed for your information: <br />• Draft Planning Commission minute dated July 10, 2008 <br />• Draft City Council minutes dated July 22, 2008 <br />• Proposed ordinance <br />• Map of Proposed Tower Overlay Districts <br />-285- <br />
