WHEREAS, the City finds and declares that it is in the public interest to acquire title to <br />and possession of the Required Properties prior to the filing of an award by the Court Appointed <br />Commissioners; and <br />• WHEREAS, the property owner of the Required Properties and the Anoka County PIN <br />for the said Property Interests have been identified by the City as follows: <br />'PIN FEE OWNER ;PROPERTS' INTEREST TO BE` ACQUIRED <br />10-32-25-33-0012 Mack J: and Shayle L. Collins Tem .Construction Easement. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, AS FOLLOWS: <br />1. That in order to carry out the purposes and. objectives described above it is necessary to <br />acquire the Required Properties. <br />2, The acquisition of the Required Properties by exercise of eminent domain in the manner <br />provided by Minnesota Statute Chapter 117 serves a public interest and is deemed to be <br />necessary. <br />3. The City deems it necessary for the reasons set forth above to proceed without delay <br />under Minn. Stat. ~ 117.042 to pay to the owners or into court a sum of money to serve as <br />compensation to the owner of the Required Properties, which amount shall be equal to <br />Petitioner's approved appraisal of value as determined by the City. <br />4. That the City Administrator is hereby directed to acquire the Required Properties as <br />described above in accordance with Minnesota Statutes. The City Administrator is <br />authorized to negotiate and represent the City of Ramsey in all proceedings. <br />5. That if the Required Properties cannot be acquired by .direct negotiation, they shall be <br />.acquired by eminent domain. <br />6. That the City Council hereby authorizes acquisition of the Required Properties by <br />eminent domain and to take title and possession of that land prior to filing of an award by <br />the Court Appointed Commissioners pursuant to Minn. Stat. § 117.011 and ~ 117.042. <br />7. That the City Attorney is authorized to file the necessary petition therefore, .and to <br />prosecute such action to a successful conclusion or until it is abandoned, dismissed or <br />terminated .by the City or Court. <br />-341- <br />
