<br />Community Development Director Miller rejoined the Special City Council meeting. <br /> <br />Mr. Bray stated that he would like to quickly update the Council on the status of the mechanic's <br />lien litigation. He stated that the original plaintiffs were EMJ Pipe, URS, and Rehbein. He <br />noted that EMJ Pipe got out a few months ago and URS is also asking that they be dismissed. <br />He stated that Rehbein is still in litigation. He stated that in a discussion he had with the attorney <br />for URS, he was told that Rehbein is considering proceeding on some "novel" theory, but URS <br />was not interested in participating. He stated that he is unsure if Rehbein will continue to move <br />forward with this. <br /> <br />Councilmember Elvig asked what the dollar amounts were in this case and what Mr. Bray <br />thought a "novel" theory would be. <br /> <br />Mr. Bray stated that Rehbein is about $6 million or $7 million and URS is about $60,000. He <br />stated that he has no answer as to what their "novel" theory may be, but suspects that it is just <br />very hard for them to walk away from $6 to $7 million. He stated that he has been told that this <br />will be resolved in the not too distance future because the courts want this completed. <br /> <br />Case #2: <br /> <br />Consider Issues Related to HSP vs. City of Ramsey <br /> <br />City Attorney Goodrich suggested that this case be conducted in a closed session. <br /> <br />Motion by Councilmember Jeffrey, seconded by Councilmember Olson, to move the Special <br />City Council Meeting into a closed session. <br /> <br />Motion carried. V oting Yes: Mayor Gamec, Councilmembers Jeffrey, Olson and Elvig. Voting <br />No: None. Absent: Councilmembers Dehen, Look and Strommen. <br /> <br />The closed session ended at 6:29 p.m. <br /> <br />MAYOR, COUNCIL AND STAFF INPUT <br /> <br />None <br /> <br />ADJOURNMENT <br /> <br />Motion by Councilmember Olson, seconded by Councilmember Jeffrey, to adjourn the Special <br />City Council meeting. <br /> <br />Motion carried. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Olson, Jeffrey <br />and Elvig. Voting No: None.
