<br />Based on all of the proceedings herein, the Hearing Examiner makes the following: <br /> <br />FlliDJ'NQS QF FbQT <br /> <br />1. The R.espondent is an owner of record of thepropel'ty located at 6203 Rlvlyn Avo NW I in <br />the City of Ramsey, Anoka County, Minnesota (lithe Property"), <br /> <br />2. The Property is located in a Residential District and zoned as R~ 1 under Ramsey City <br />Code Chapter 9. The Property is also located within the Metropolitan Urban Service Area <br />("the MUS A"), <br /> <br />3. On November 27, 2007, Community Service Officer Carey Schiferli ("CSO SchiferW') of <br />the Ramsey Police Department observed a large, white panel van ("the Van") parked on <br />the Property, CSO Schiferli observed that the Van was parked in the easterly side yard of <br />the Property on a dirt surface. CSO Schiferli testified that the Van was parked in a drive <br />lane between the street and a garage or storage shed in the side yard of the Property. <br /> <br />4. The Respondent testified that the Van is a licensed and operable motor vehicle that is <br />oWl1od by hIs wife. The van is anon-commercial' motor vehicle. <br /> <br />5. The l\espondent received an administrative citation in this matter via certified n'lail on <br />Deoen10er 18; 2007 I The Respondent demanded a hearh'lg on the matter p\l.r~uant to that <br />citation within 14 days ofreceiving it. Notice and Order tor Hearing in this matter was <br />sel'ved on the Respondent o~ Apri118, 2008, <br /> <br />6. On March 11,2008 and again on May 5, 2008, CSO Schif'erli returned to the Property <br />and observed the Van parked in the easterly side yard of the Property on a dirt surface. <br />CSO Schiferli testified that the Van has not moved substantially from where he flXst <br />observed it on November 27,2007. <br /> <br />7. City Code 9.11 regulates the off~stl'eet parking of various classes of motor vehicles <br />according to the zoning district in which they are parked. Section 9,11 applies to <br />residentia.l properties located within the MUSA. It restricts off.street purking of non <br />commercial motor vehicles to bituminous pavemel7+t or conorete surface if the vehicle is <br />parked in the side or rear yard. . . , <br /> <br />8. The Van is not park.ed on a concrete bituminous pavement or cone,rete surface, <br />
