Un- <br />der the caunty's Industrial Zoning Ordinance (IZO) thatland was zoned <br />as I-4-S, the heaviest industrial classificatian. 600 Land saught to build a <br />"solid waste transfer statian" an the land. Under the develapment plan, <br />trucks wauld bring laads af salid waste and recyclables to. a "transfer <br />statian"-a building where the trucks wauld be unlaaded arid the laads <br />wauld be stared' tempararily. The laads- wauld then be reloaded anta <br />larger trucks to. be taken to. incineratars, landfills, ar recycling facilities. <br />The Indianapalis Department af Metrap'alitan Develapment (DMD), <br />which was respans~ble far administering the IZO, advised 600 Land that <br />/ " it needed a spe~ial exceptian to. aperate the prapased. transfer statian. <br />( ) 600 Land filed a petitian far a specialexceptian with the caunty Baard <br />af Zaning Appeals' (BZA). The BZA denied the petitian. <br />600 Land then appealed the BZA's denial to. the trial caurt. On ap- <br />peal, 600 Land asked the caurt to. declare that the IZO did nat require <br />it to. abtain a specialexceptian. 600 Land argued that Its propased use <br />qualified as a '''matar truck t'erminal," which was an explicitly permitted <br />use in the I-4-S Zane. <br />The trial caurt held that the IZO did require 600 Land tp abtain a <br />special use exceptian far the transfer statian. It then affirmed the denial <br />af the special exceptian. <br />600 Land appealed. <br />. The Caurt af Appeals agreed that a special exceptian was required. <br />Hawever, it reversed the BZA's denial af the special exceptian, finding <br />the denial was nat supparted by evidence. ' <br />The Supreme Caurt af Indiana granted the BZA's request far transfer. <br /> <br />DECISION: Trial caurt reversed. <br /> <br />( ) <br /> <br />The caurt cancluded that a special exceptian w~s nat required because <br />the propased salid waste transfer station was, 'as 600 Land had argued, a <br />"matar truck terminal," which was a permitted use in the 14-S zane. <br />In reaching its canclusian, the caurt canstrued the IZO's definitian af <br />"matar truck terminal."
