App. Div. 2008) <br /> <br />NEW JERSEY (04/30/08) - The Abbotts arid the Millers owned ad- <br />jacent waterfront properties located along the Sunset Canal in Margate <br />City, New Jersey. In 2005, the Abbotts replaced a rotting bulkhead, built <br />a floating and fixed dock, and significantly modified their' existing rear <br />deck. They did not obtain a permit to reconstruct the deck. The city <br />later determined that the Abbotts' reconstructed deck violated the zon- <br />ing ordinance because it did not meet height and setback requirements. <br />The city's zoning officer determined that the Abbotts' deck exceeded 18 <br />inches above grade. Under the city's zoning ordinance, decks that exceed- <br />ed18 inches above grade had to" be setback atleast three feet from the <br />property line in the rear yard and ten feet behind the bulkhead. <br />The Abbotts asserted that they raised the grade on their property be- <br />cause of drainage issues and argued that measurements should be tak- <br />en from that gral;le.
