<br />Board Member <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #08-09-_ <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO CHAD AND <br />MELODIE STORBAKKEN AT 16021 OSMIUM STREET NW (pERMITTEES) FOR <br />ACCE.SSORY STRUCTURE SIDEWALL HEIGHT RESTRICTIONS AND <br />DECLARING TERMS OF SAME <br /> <br />WHEREAS, Chad & Melodie Storbakken (permittees) have properly. applied for a <br />variance from Section 9.11.02 (Accessory Uses & Buildings) of the Ramsey City Code for the <br />sidewall height of an accessory building on the property generally known as 16021 Osmium St <br />NW and legally described as follows: <br /> <br />Lot 2, Block 7, Hall-Anderson Acres, subject to easement as shown on the plat, (subject <br />to easement grant 4-2-74), Anoka County, Minnesota <br /> <br />{Subject Property). <br /> <br />AND.WHEREAS, the. Board of Adjustment conducted a public hearing on September 4, <br />2008, pursuant to Section 9..03.07 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, ST~TE OF MINNESOTA, as follows: <br /> <br />1. That based on Findings of Fact # _ a variance to the sidewall height restriction of an <br />accessory building on the Subject Property is hereby granted. <br /> <br />2. That the sidewall height of the accessory building- shall not exceed thirteen and a half (13.5) . <br />feet. <br /> <br />3. That no other structure or addition shall be constructed unless it is in accordance with City <br />Code. <br /> <br />4. That the Permittees shall be responsible for all costs incurred in administering and enforcing <br />this variance. <br /> <br />5. That the Permittees shall obtain all necessary permits prior.to commencing any construction <br />of the accessory building. <br /> <br />6. That the accessory buileling shall be used for storage of personal property and that no <br />commercial activity orany type shall be permitted in said structure unless it is in accordance <br />. with City Code. <br /> <br />7. That the Permittees agree that the terms. of this Variance shall be binding upon its successors <br />and assigns. <br /> <br />13 <br />
