Board Member introduced the following resolution and moved for its adoption: RESOLUTION #08-09-_ A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO CHAD AND MELODIE STORBAKKEN AT 16021 OSMIUM STREET NW (pERMITTEES) FOR ACCE.SSORY STRUCTURE SIDEWALL HEIGHT RESTRICTIONS AND DECLARING TERMS OF SAME WHEREAS, Chad & Melodie Storbakken (permittees) have properly. applied for a variance from Section 9.11.02 (Accessory Uses & Buildings) of the Ramsey City Code for the sidewall height of an accessory building on the property generally known as 16021 Osmium St NW and legally described as follows: Lot 2, Block 7, Hall-Anderson Acres, subject to easement as shown on the plat, (subject to easement grant 4-2-74), Anoka County, Minnesota {Subject Property). AND.WHEREAS, the. Board of Adjustment conducted a public hearing on September 4, 2008, pursuant to Section 9..03.07 of the Ramsey City Code. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, ST~TE OF MINNESOTA, as follows: 1. That based on Findings of Fact # _ a variance to the sidewall height restriction of an accessory building on the Subject Property is hereby granted. 2. That the sidewall height of the accessory building- shall not exceed thirteen and a half (13.5) . feet. 3. That no other structure or addition shall be constructed unless it is in accordance with City Code. 4. That the Permittees shall be responsible for all costs incurred in administering and enforcing this variance. 5. That the Permittees shall obtain all necessary permits prior.to commencing any construction of the accessory building. 6. That the accessory buileling shall be used for storage of personal property and that no commercial activity orany type shall be permitted in said structure unless it is in accordance . with City Code. 7. That the Permittees agree that the terms. of this Variance shall be binding upon its successors and assigns. 13
