Absent: Board Members Brauer and Nixt. <br /> <br />PUBLIC HEARINGS/BOARD BUSINESS <br /> <br />Case #1: <br /> <br />Public Hearing - Request for a Variance for Placement of an <br />Accessory Structure Closer to the Front Property Line than the <br />Principal Structure; Case of John Ives <br /> <br />Chairperson Van Scoy closed the regular portion of the Board of Adjustment meeting at 7:05 <br />p.m. in order to conduct the public hearing. <br /> <br />Public Hearin2 <br /> <br />Chairperson Van Scoy called the public hearing to order at 7:05 p.m. <br /> <br />Presentation <br /> <br />Associate Planner Gladhill explained that Mr. Ives has applied to construct an accessory building <br />closer to the front property line than the principal structure on the property located at 14630 <br />Bowers Drive NW. <br /> <br />Associate Planner Gladhill noted the subject parcel is approximately 0.85 acres in size, zoned R- <br />1 Single Family, and is in the Mississippi River Critical Area" Overlay District. City Code has <br />established a 40-foot front yard setback and a 200 foot setback from the ordinary high water <br />(OHW) line for residential parcels in the Mississippi River Critical Area Overlay District. The <br />principal dwelling is located 138 feet from the front property line and the proposed detached <br />accessory building will be approximately 43 feet from the front property line. <br /> <br />Associate Planner Gladhill stated the site plan reveals the property is significantly covered by <br />mature tree growth and" bordered by the Mississippi River. The site is long and narrow, and a <br />variance has previously been approved for the parcel which restricts allowing encroachment into <br />the OHW setback. Associate Planner advised that the application was forwarded to the DNR, <br />who reviews all variances within the Mississippi River Critical Area, and they indicated no <br />objection to this request for a variance to place the accessory structure closer to the front property <br />line than the principal structure. <br /> <br />Board of Adjustment I July 10,2008 <br />Page 2 of 4 <br />
