Absent: Board Members Brauer and Nixt.

PUBLIC HEARINGS/BOARD BUSINESS

Case #1:

Public Hearing - Request for a Variance for Placement of an
Accessory Structure Closer to the Front Property Line than the
Principal Structure; Case of John Ives

Chairperson Van Scoy closed the regular portion of the Board of Adjustment meeting at 7:05
p.m. in order to conduct the public hearing.

Public Hearin2

Chairperson Van Scoy called the public hearing to order at 7:05 p.m.

Presentation

Associate Planner Gladhill explained that Mr. Ives has applied to construct an accessory building
closer to the front property line than the principal structure on the property located at 14630
Bowers Drive NW.

Associate Planner Gladhill noted the subject parcel is approximately 0.85 acres in size, zoned R-
1 Single Family, and is in the Mississippi River Critical Area" Overlay District. City Code has
established a 40-foot front yard setback and a 200 foot setback from the ordinary high water
(OHW) line for residential parcels in the Mississippi River Critical Area Overlay District. The
principal dwelling is located 138 feet from the front property line and the proposed detached
accessory building will be approximately 43 feet from the front property line.

Associate Planner Gladhill stated the site plan reveals the property is significantly covered by
mature tree growth and" bordered by the Mississippi River. The site is long and narrow, and a
variance has previously been approved for the parcel which restricts allowing encroachment into
the OHW setback. Associate Planner advised that the application was forwarded to the DNR,
who reviews all variances within the Mississippi River Critical Area, and they indicated no
objection to this request for a variance to place the accessory structure closer to the front property
line than the principal structure.

Board of Adjustment I July 10,2008
