<br />Councilmember Jeffrey introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #08-09-172 <br /> <br />A RESOLUTION IDENTIFYING FINDINGS, APPROVING A COMPRHENSIVE PLAN <br />AMENDMENT TO EXTEND SANITARY SEWER AND MUNICIPAL WATER INTO THE <br />2010-2015 STAGING AREA PRIOR TO 2010, AND AUTHORIZING CITY STAFF TO <br />SUBMIT AN APPLICATION TO THE METROPOLITAN COUNCIL FOR AN <br />'AMENDMENT TO THE COMPREHENSIVE PLAN <br /> <br />WHEREAS, on July 14, 2004 and May 13,2008, respectively, the City of Ramsey approved <br />the commercial development of the following legally described parcels with sanitary sewer and <br />municipal water services: <br /> <br />Lot 1, Block 5, Alpaca Estates, Anoka County, Minnesota <br />Lot 1, Block 1, Alpaca Estates, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br />WHEREAS, the Comprehensive Plan approved in 2001 shows the Subject Property designated <br />land use as Places to Shop and that the Subject Property is included in the Metropolitan Urban Service <br />Area; and <br /> <br />,WHEREAS, the Comprehensive Plan approved in 2001 contains a Development Staging Plan <br />to serve as a guide for the extension of urban services that reflects that the Subject Property would <br />receive urban services in the time period 2010-2015; and <br /> <br />WHEREAS, Minnesota Statutes Section 473.858 was amended in 2006 to allow Metropolitan <br />Council to define 'minor comprehensive plan amendments' and shorten or waive the review and <br />comment period for adjacent governmental units and/or special affected special districts; and <br /> <br />WHEREAS, in 2007 the Metropolitan established the following criteria for minor <br />comprehensive plan amendments: 1) involves a site of 40 acres or less; 2) does not change the <br />community's growth forecasts for 2010-2030 or TAZ allocation; 3) amendment site is not within one- <br />quarter mile of an adjacent jurisdiction; or according to the waiving City's adopted ordinances, outside <br />of the defined distance requirement to notice adjacent property owners of a comprehensive plan <br />change, whichever is less; and <br /> <br />WHEREAS, the Subject Property totals approximately 2.7 acres; the development occurring <br />does not change the community's growth forecasts for 2010-2030 or TAZ allocation; and the Subject <br />Property is not within one.;.quarter mile, or within the 350 feet distance requirement to notice adjacent <br />property owners of a comprehensive plan amendment; and <br /> <br />WHEREAS, the Ramsey Planning Commission met on September 4,'2008, conducted a public <br />hearing, and recommended that the Ramsey City Council approve the minor comprehensive plan <br />amendment to vary from the Comprehensive Plan Staging Plan to facilitate development that is <br />occurring on the Subject Property. <br />
