CONSENT # ) O <br />RESOLUTION ADOPTING THE RENEWAL OF THE ANOKA COUNTY JOINT <br />POWERS AGREEMENT <br />By: James Way, Police Chief <br />Background: <br />The: Anoka County Joint. Law .Enforcement Council Joint Powers Agreement. (JPA) was created <br />in 1970. The Agreement has been updated over the years as changes in public safety.. have <br />occurred. The following is and overview of the changes to the JPA for the Joint Law <br />Enforcement Council. <br />1. Incorporates the previous JPA for the. public safety communication system (2003), the <br />previous JPA for the Joint Law Enforcement Council (1970 & 1982), .and the <br />previous amendment of the JPA for the Joint Law Enforcement Council (2001) into- a <br />single JPA, eliminating. the provisions that no longer apply due. to completion. <br />2. Clarifies the procedure for withdrawal from the JPA including 30 day notice <br />provision. <br />3. Makes the County Attorney a voting member of the council. Previously the County <br />Attorney's membership was based. on his election as chair.. This change allows the <br />Council the flexibility to have a different chair, but still continue the County <br />Attorney's participation in the JLEC. <br />4. Clarifies the start and end dates of the terms of the JLEC membership and allows for <br />appearance by a proxy. This change helps to resolve quorum problems and allows <br />- the member agencies to designate someone else from their agency to attend and vote <br />when the regular member is absent. The remaining quorum rules are dealt with in the <br />JLEC Rules of Procedure instead of the JPA. <br />5. Sets forth the budget process for funding the RMS and communications system, along <br />with any future projects. <br />6. Sets forth the termination of the agreement including what happens to any property <br />the JLEC possesses upon termination (required by statute). <br />The Anoka County Joint Law Enforement Council recommended that the agreement be .updated <br />to address current. issues. The enclosed agreement represents the conclusion of the Joint Law <br />Council as to .its terms. <br />Funding: <br />None <br />Staff Recommendation: <br />Staff recommends execution of the agreement renewing the Anoka County Joint Powers <br />Agreement with the outlined changes. <br />-101- <br />
