<br />CASE # '-I <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR A PRIVATE DOG KENNEL TO <br />MAINTAIN FO~ OR MORE DOGS ONA PARCEL; <br />CASE OF LYNETTE AND DAVID RANDALL <br />By: Tim Gladhill, Associate Planner <br /> <br />Background: <br /> <br />On May 29, 2008, the City received an application from Lynette and David Randall for a private <br />kennel conditional use permit to maintain a maximum of five dogs on the property at 7960 171 st <br />Lane NW. City Code allows for a maximum of three dogs perparcel;four or more dogs require- <br />a Conditional Use Permit. <br /> <br />. The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Request submitted by Applicants <br />. c) Letter from neighbor in support of request <br />d) Letter from neighbor not in support of request <br />e) DRAFT Planning Commission Minutes dated September 4, 2008 <br />f) Proposed findings of fact <br />g) Proposed conditional use permit <br /> <br />Notification: <br /> <br />In accordance with State Statute, staff attempted to notify all property owners within 350 feet of <br />the subject property of the request. <br /> <br />Observations: <br /> <br />The subjectpiopertyis approximately 2.27 acres and is zoned R-l Rural Developing. The <br />Applicant has requested a Conditional Use Permit to allow for five dogs on the Subject Property. <br />These dogs currently reside on the property and consist of one labIDalmatian mix, one Shih Tzu, <br />one Terrier, and two Dachshunds. The applicants have stated that all of these animals are rescued <br />animals and all reside within the home; hone of the animals are housed outside. Furthermore, the <br />applicant has stated that all are neutered, licensed, and current on all vaccinations. <br /> <br />On September 4,2008, the Planning Commission met to discuss the request. A resident stated at <br />the Public Hearing that. the dogs are sometimes seen running at large in the front yard and <br />occasionally into the street. The Planning Commission recommended that language be added to <br />the Conditional Use Permit stating that all dogs be physically contained at all times, either by a <br />temporary or permanent means of fencing, leashes, etc. <br /> <br />-177- . <br />
