Consent
. CASE #
PROPOSED ORDINANCE TO AMEND OFF-STREET PARKING REGULATIONS;
CASE OF CITY OF RAMSEY
By: Sylvia Frolik, Asst. Community Development Director
Background:
Currently, Section 9..11.08 (Off-Street Parking) of City Code allows for the outdoor storage. of
one (1) unlicensed vehicle. This. provision conflicts with Section 5..08 (Public- Nuisance).
Section 5.08 prohibits the outdoor storage of inoperable vehicles and it states that an unlicensed
vehicle is considered inoperable.
Observations•
The proposed ordinance eliminates. the contradiction between Chapter 5 and .Chapter 9 by
removal of that text which allows for the outdoor storage of one (1) unlicensed vehicle. While
..working on the draft ordinance, it became apparent to City Staff that Section 9.11.08 (Off-Street
Parking). and 9.11.09 (Number of Parking Spaces Required) are in need of some reorganization.
Section 9.11.08 addresses commerciaUindustrial, as well as residential, parking regulations.
Section 9.11.09. contains additional commercaUindustrial regulations. The proposed ordinance
relocates the commerciaUindustrial regulations from 9.11.08 to 9.11.09. The end result is that
9.11.08 is applicable to residential uses only and 9.11.09 is applicable to commerciaUindustrial
.uses..
Notification:
In accordance with State Statute and City Code, the public hearing notice was published in the
official newspaper. The Planning Commission conducted the public hearing on .September 4,
2008.
Attachments:
1. Proposed ordinance with edits identifying deletions and additions
Funding:
Costs incurred in processing this City-initiated amendment to City Code are covered by regular
staff time.
Recommendation:
The Planning Commission has recommended adoption of the ordinance.
-21-
