Town of Brookline, 452 Mass. 109, <br />891 N.E.2d 219 (2008) <br /> <br />MASSACHUSETTS (08/04/08)-The town granted 81 Spooner Road <br />LLC (Spooner) a building permit to construct a single-family residence <br />(SFR) on a vacant lot in the town. Neighbors challenged the building <br />permit. Eventually, the town's zoning board of appeals rescinded the per- <br />mit. It did so because it found that the gross floor area of the proposed <br />house produced a floor-to-area ratio that exceeded the maximum permit- <br />ted under the town's zoning bylaw. <br />Section S.20 of the town's zoning bylaw (the bylaw) regulated land <br />use in different zoning districts through, among other things, a' maxi- <br />mum floor-to-area ratio.
