<br />5.20 Enforcement--Revised <br /> <br />Subdivision 1. The City Council of the City of Ramsey has determined that the health, <br />safety, good order, general welfare, and convenience of the public is threatened by certain public <br />nuisances or City Code vio.latio.ns en pro.perty within the City limits and finds the need fer <br />alternative metho.ds o.f enfo.rcing City Cede. While criminal fines and penalties have been the <br />mo.st frequent enfo.rcement mechanism, there are certain negative co.nsequences for both the city <br />and the accused. The delay inherent in that system do.es net ensure pro.mpt reso.lutio.n. <br />Acco.rdingly, the City Co.uncil finds that the use o.f abatement, administrative citatio.ning, and <br />administrative hearings is an additio.n to. any ether legal remedy that may be pursued. The City <br />has the o.ptio.n to. utilize any o.f the fo.llo.wing three pro.cedures to. enfo.rce the City Cede. These <br />pro.cedures may be used separately, o.r in co.mbinatio.n, to. alleviate the vio.latio.n. <br /> <br />Subdivision 2. Abatement. <br /> <br />a. ApplicatiQn. . This Sectio.n shall apply to. the abatement of all public nuisances <br />and ether vio.latio.ns as defined within the City Cede unless ano.ther pro.cedure is <br />specifically pro.vided. <br /> <br />b. Hearing Examiner and the Administrative Hearing <br /> <br />1. Position Created. The po.sitio.n o.f Hearing Examiner is hereby created. <br />The City Administrato.r o.r hislher designee may, at their discretio.n and <br />with appro.val o.f the City Co.uncil, co.ntract with third parties fer the <br />. furnishing o.f all services o.f the Hearing Examiner asco.ntained in this <br />subsectio.n and set the rate o.f co.mpensatio.n therefore in the City's Rates <br />and Charges. <br /> <br />2. Duties o.f Hearing Examiner. The Hearing Examiner shall have the <br />fo.llo.wing duties: <br /> <br />(a) Set dates and hear all co.ntested cases fo.llo.wing appeals o.f <br />o.rders o.f the City Administrato.r o.r his/her designee. <br /> <br />(b) Take testimo.ny from all interested parties. <br /> <br />(c) Make a co.mplete reco.rd o.f all pro.ceedings. <br /> <br />(d) Affirm, repealer mo.dify the order o.f the City <br />Administrato.r and hislher designees, and prepare written <br />findings o.f fact. <br /> <br />c. Inspections and Investigations <br /> <br />1. Perio.dic Inspectio.ns.
