EXHIBT C: DECLARATION OF COVENANTS On this _ day of , 2008, 21't Century Bank, a Minnesota Corporation ("Declarant") owner and proprietor of the following described properties in the County of Anoka, State of Minnesota, described as follows: Lot 10, Block 3; Lot 1, Block 4; Lots 1 through 24, inclusive, Block 6; Lots 1 through 28, inclusive, Block S; All in the plat of Town Center Gardens P Addition, Anoka County, Minnesota Hereby imposes the following restrictions on certain activities regarding said lots: 1. Landscaping Re uirement and Escrow Prior to the time of applying for any building permit on any lot described above, the owner thereof shall first submita landscaping plan to the City of Ramsey for approval, and shall deposit with the City of Ramsey a cash escrow to be established by the City engineer to guarantee the timely and proper installation of landscaping in accord with the landscaping plan. The issuance of a building permit by the City of Ramsey shall be deemed to be the approval of the landscaping plan and acceptance of the required amount of cash surety. The .applicant shall execute any documents reasonably requested, by the City of Ramsey pursuant to such surety and building permit. For the purposes of this Declaration, a "building permit" shall be deemed to mean a permit for the construction of a single family dwelling (including townhomes) meeting city codes, and does not pertain to a building permit to construct an accessory building or other structure not intended for human habitation, 2. Right to Deny The Declarant hereby authorizes the City of Ramsey to deny the issuance of any building permit to any owner of a lot or lots who does not submit a landscaping plan acceptable to the City of Ramsey, or who fails to deposit the required cash surety. 3. Binding on Successors This Declaration is irrevocable, and is binding on the successors in interest of the Declarant, provided, that as to any lot for which a building permit is issued, the issuance of the building permit shall serve as conclusive and incontrovertible evidence that the owner of such lot has complied with the conditions hereof, and upon the recording of an -106-
