EXHIBT C: DECLARATION OF COVENANTS <br />On this _ day of , 2008, 21't Century Bank, a Minnesota <br />Corporation ("Declarant") owner and proprietor of the following described properties in <br />the County of Anoka, State of Minnesota, described as follows: <br />Lot 10, Block 3; <br />Lot 1, Block 4; <br />Lots 1 through 24, inclusive, Block 6; <br />Lots 1 through 28, inclusive, Block S; <br />All in the plat of Town Center Gardens P Addition, Anoka County, Minnesota <br />Hereby imposes the following restrictions on certain activities regarding said lots: <br />1. Landscaping Re uirement and Escrow <br />Prior to the time of applying for any building permit on any lot described above, the <br />owner thereof shall first submita landscaping plan to the City of Ramsey for approval, <br />and shall deposit with the City of Ramsey a cash escrow to be established by the City <br />engineer to guarantee the timely and proper installation of landscaping in accord with the <br />landscaping plan. The issuance of a building permit by the City of Ramsey shall be <br />deemed to be the approval of the landscaping plan and acceptance of the required amount <br />of cash surety. The .applicant shall execute any documents reasonably requested, by the <br />City of Ramsey pursuant to such surety and building permit. For the purposes of this <br />Declaration, a "building permit" shall be deemed to mean a permit for the construction of <br />a single family dwelling (including townhomes) meeting city codes, and does not pertain <br />to a building permit to construct an accessory building or other structure not intended for <br />human habitation, <br />2. Right to Deny <br />The Declarant hereby authorizes the City of Ramsey to deny the issuance of any building <br />permit to any owner of a lot or lots who does not submit a landscaping plan acceptable to <br />the City of Ramsey, or who fails to deposit the required cash surety. <br />3. Binding on Successors <br />This Declaration is irrevocable, and is binding on the successors in interest of the <br />Declarant, provided, that as to any lot for which a building permit is issued, the issuance <br />of the building permit shall serve as conclusive and incontrovertible evidence that the <br />owner of such lot has complied with the conditions hereof, and upon the recording of an <br />-106- <br />
