CASE # 8 <br />REQUEST TO DEVIATE FROM THE SURFACING <br />REQUIREMENT IN THE E-1 EMPLOYMENT DISTRICT; <br />CASE OF MINNDAK MECHINICAL, INC. <br />By: Chris, Anderson, Environmental Coordinator <br />Background: <br />MinnDak Mechanical, Inc. received site plan approval in 2002 for the construction of a 15,000 <br />f 156h Ave NW. The original improvements, including the facility and <br />square foot facility off 0 <br />parking/storage areas, covered roughly half the site. The remainder of the site was left in its <br />natural state, separated by a bituminous barrier curb, in anticipation of a future expansion. There <br />is an interest now in utilizing the remaining unimproved area for additional outside storage and <br />MinnDak Mechanical, Inc. is requesting a waiver to the pavingrequirement of the E-1 <br />Employment District. <br />The following items are enclosed for your information: <br />a) Site location Map <br />b) Site plan identifying area to be improved <br />C) Summary of operations from prospective buyer, Rain for Rent <br />Notification: <br />This type of request does not require a public hearing. <br />Observations: <br />MinnDak Mechanical, Inc, is attempting to sell their property and the prospective buyer, Rain for. <br />, Rent, intends to utilize the unimproved portion of the site for outdoor storage of their rental <br />equipment. Rain for Rent believes that. a gravel surface, rather than concrete or bituminous, <br />would be more accommodating for their intended use. <br />Section 9,20.24 (E-1 Employment District) Subdivision 3 (Accessory Uses) states that open and <br />outdoor storage as an accessory use of the property shall be permitted provided that the storage <br />area is surfaced to control dust and subject to the approval of the Zoning Administrator. The <br />intent of this requirement. was to require concrete or bituminous surfaces along with B6/12. <br />concrete curbing. Since the early 1990's, Staff has worked to eliminate that language from the <br />various sections of City Code and to specify appropriate surfaces, which is now reflected in all <br />the other zoning districts. Past practice has been to require concrete or bituminous surfaces and <br />86/1'2 concrete curbing for all parking, maneuvering and outdoor storage areas as was the <br />original intent, of the surfacing standard. Deviating from the surfacing requirement requires City <br />Council approval. <br />-337- <br />
