CASE # 1 <br />ADOPT ORDINANCE TO ,AMEND OFF-STREET PARKING REGULATIONS; <br />CASE OF CITY OF RAMSEY <br />By: Sylvia Farolik, Asst, Community Development Director <br />Background: <br />Currently, Section 9.11.08 (Off -Street Parking) of City Code allows for the outdoor storage of <br />one. (1) unlicensed vehicle. This provision conflicts with Section 5.08 (Public Nuisance). <br />Section 5.08 prohibits the outdoor storage of inoperable vehicles and it states that an unlicensed <br />vehicle is considered inoperable. <br />Observations: <br />The proposed ordinance eliminates the contradiction between Chapter 5 and Chapter 9 by <br />removal of that text which allows for the outdoor storage of one (1) unlicensed vehicle, While <br />working on the draft ordinance, it became apparent to City Staff that Section 9.11.08 (Off-street <br />Parking) and 9.11.09 .(Number of Parking Spaces Required) are in need of some reorganization. <br />Section 9.11,08 addresses commercial/industrial, as well as residential, parking regulations. <br />Section 9,11.09 contains additional commercial/industrial regulations. The proposed ordinance <br />relocates the commercial/industrial regulations from 9.11.08 to 9.11.09. The end result is that <br />9.11.08 is applicable to residential uses only and 9.11.09 is applicable to commercial/industrial <br />uses. <br />Notification: <br />In accordance with State Statute and City Code, the public hearing notice was published in the <br />official newspaper. The Planning Commission conducted the public hearing on September 4, <br />2008. <br />Attachments: <br />1. Proposed ordinance with edits identifying deletions and additions <br />Funding:. <br />Costs incurred in processing this City-iniiiated amendment to City Code are covered by regular <br />staff time. <br />Recommendation: <br />The City Council introduced the ordinance on September 23, 2008.
